Terms and conditions
Last updated: October 2026
1. Scope
These general terms govern subscriptions to the software as a service (SaaS) products and online services operated by PeakMotion Sàrl. Specific products may have their own terms. In case of conflict, the specific terms of the product concerned prevail.
2. Formation of the contract
The contract is formed when you subscribe online and accept these terms. You confirm that the information you provide when subscribing is accurate and up to date.
3. Prices and billing
The applicable prices are those shown on the product website at the time of subscription. Payments are processed by our payment provider Stripe. We do not store your card details. Amounts are billed in advance, at the start of each subscription period.
4. Term and automatic renewal
Subscriptions run for a monthly or yearly period, depending on the plan chosen. They renew automatically for a period of the same length unless cancelled before the end of the current period.
5. Cancellation
You may cancel your subscription at any time, from your account where the product allows it, or by email to info@peak-motion.ch. Cancellation takes effect at the end of the current subscription period. Access to the service remains available until that date.
6. Refunds
Periods that have already started are not refunded, unless mandatory law provides otherwise.
7. Use of the service
You agree to use the service lawfully and for its intended purpose, to keep your credentials secure and not to interfere with its operation or the rights of third parties. In the event of a breach, we may suspend or terminate access to the service.
8. Availability and changes
We strive to provide a reliable and available service, but cannot guarantee uninterrupted availability. We may evolve features in order to improve the service.
9. Data protection
The processing of personal data is described in our privacy policy and, where applicable, in the privacy policy of the product concerned.
10. Liability
To the fullest extent permitted by law, the liability of PeakMotion Sàrl is excluded, in particular for indirect damage, loss of profit and loss of data. Liability for intent or gross negligence, as well as any liability that cannot be excluded by law, remains reserved.
11. Changes to these terms
We may amend these terms. Material changes are notified to you in advance and apply from the next subscription period.
12. Governing law and jurisdiction
These terms are governed by Swiss law. The exclusive place of jurisdiction is Fribourg, Switzerland, subject to any mandatory place of jurisdiction provided by law, in particular for consumers.
